14. Dispute Resolution: Injunctive Relief

Enforcement and Oversight
LINĒIJ™ has established procedures for periodically verifying implementation of and compliance with the Safe Harbor principles. We conduct an annual self-assessment of our practices with respect to Personal Information to verify that representations we make about our Personal Information privacy practices are true and that related privacy policies have been implemented as represented.
Customers and Employees may file a complaint with LINĒIJ™ in connection with the processing of their Personal Information under the Safe Harbor principles. We will also cooperate with the following dispute resolution bodies to address individual's complaints regarding privacy issues: (i) for Customer complaints, we cooperate with the American Arbitration Association in accordance with its applicable commercial rules; (ii) for complaints concerning our handling of Employee Personal Information, we cooperate with the relevant EU data protection authorities. We will take steps to remedy any issues arising out of a failure to comply with the Safe Harbor principles. Any complaints or disputes by EU citizens about privacy that cannot be resolved directly with LINĒIJ™, will be resolved through the EU Safe Harbor Dispute Resolution Procedure by the American Arbitration Association at 1633 Broadway, 10th Floor, New York, NY 10019-6708. Any dispute, difference, controversy or claim between us or by either of us against the other or the employees, agents, mandataries, officers, directors, successors, assigns or affiliates of the other, arising out of, relating to, or having any connection with, the present terms, this website, any use of this website and any transaction conducted on or from it (whether contractual or extra-contractual, in contract or tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future), including any question regarding negotiation, formation, existence, validity, performance, effects, interpretation, breach, resolution or annulment and further including the applicability or scope of this arbitration clause (hereinafter collectively referred to as “Claims” and each, individually, as a “Claim”) shall be referred to and finally resolved by binding arbitration, to the exclusion of courts of law which Schedule is incorporated into and forms an integral part of these terms. If the dispute cannot be satisfactorily resolved within thirty (30) days from the date you, or LINĒIJ™ is notified by the other of a dispute, then either party may then initiate the arbitration process. For greater certainty, no recourse may be made by either party to any court or tribunal, whether federal or provincial, or local in respect of any matter whatsoever relating to these terms including, without limitation, any Claim, any arbitration initiated to resolve a Claim, and any arbitration award made in relation to a Claim, except as expressly permitted in these terms or by law. Any award rendered pursuant to the arbitration shall be final and binding on each of the parties and no appeal shall lie from such award. Such award may be rendered enforceable and executory by any court having jurisdiction over the person or the property of the person against whom enforcement of the award is sought. NO CLAIM MAY BE JOINED WITH ANOTHER LAWSUIT, OR IN AN ARBITRATION WITH A DISPUTE OF ANY OTHER PERSON, OR RESOLVED ON A CLASS-WIDE BASIS. THE PARTIES EXPRESSLY AGREE THAT ANY CLAIM THAT IS ARBITRATED PURSUANT TO THESE TERMS SHALL NOT BE CONSOLIDATED WITH ANY OTHER ARBITRAL PROCEEDING FOR ANY REASON. THE ARBITRATOR MAY NOT AWARD DAMAGES THAT ARE BARRED BY THESE TERMS AND MAY NOT AWARD EXEMPLARY OR PUNITIVE DAMAGES OR ATTORNEYS' FEES. YOU AND LINĒIJ™ BOTH WAIVE ANY CLAIMS FOR AN AWARD OF DAMAGES THAT ARE EXCLUDED UNDER THESE TERMS.
Injunctive Relief and Provisional Relief
Notwithstanding the provisions in this Section 14, LINĒIJ™ shall have the right to seek and obtain any injunctive, provisional or interim relief from any court of competent jurisdiction to protect its trade-mark or other intellectual property rights or confidential information or to preserve the status quo pending arbitration.
15. Changes To Terms / Severability
LINĒIJ™ may modify, alter or otherwise update the terms applicable to this website from time to time. We will notify you of any such modifications to this website by posting notice of such changes on this website. Following the posting of such changes, your continued use of this site will constitute your acceptance of these terms and other policies, as modified. You will be bound by such changes. If any one of these conditions shall be deemed invalid, void, or for any reason unenforceable, such condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
17. No Waiver
The failure of LINĒIJ™ to enforce any provisions of these terms, or to respond to a breach by you or any third party of these terms shall not in any way waive the right of LINĒIJ™, to subsequently enforce any of the terms and conditions contained herein or to act with respect to similar breaches.
18. ENTIRE AGREEMENT
These terms, together with all other agreements, terms or conditions incorporated or referred to herein constitute the entire agreement between you and LINĒIJ™ with respect to the use of this website. Any transaction conducted on or from this website and its contents, supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter hereof, and may not be amended or modified except in writing, or by LINĒIJ™. Making such amendments or modifications available to it pursuant to the terms hereof.
LINĒIJ™ reserves the right, at its sole discretion, to terminate your access to all or any part of this site, with or without notice.
The headings used herein are inserted for convenience of reference only. They do not affect the construction or interpretation of the terms and conditions herein.

The primary language for this site is English. You expressly agree that these terms and all ancillary documents be drafted solely in English.
22. Purchasing Eligibility
Making a purchase on www.lineij-atelier.com and at LINĒIJ™ events is dependent on you providing your personal details, such as a real name, address, telephone number, email address, and any additional information we may need to process, fulfill, and complete your order. You will also be required to provide valid and correct payment details, which you confirm are current and are represented by you, the person you name in your billing information. www.lineij-atelier.com is only available to those who meet the LINĒIJ™ terms of eligibility, who have been issued a valid credit card by a bank acceptable to LINĒIJ™ and who have authorized LINĒIJ™ to process a charge on their credit card in the amount of the total purchase price for the merchandise which they purchase.
By purchasing merchandise on www.lineij-atelier.com, you are authorizing us to perform credit checks and where we feel necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.
www.lineij-atelier.com, LINĒIJ™ and its affiliates are not responsible for additional costs associated with taxes, VAT, duties, and or/ but not limited to customs charges imposed by your home country – or the country where products are shipped.
Consumer Responsibility for Import & Export of Exotic Materials/Skins
As the consumer it is your responsibility, and duty to check the importing/exporting requirements in your home country, to be sure you comply with those regulations before placing your order with us. If a CITES certificate is required to ship your order from the United States, or any other origination point we will provide one. CITES Certificates can take between 45-90 days to acquire from the U.S. Fish and Wildlife Service (we always lean more towards 90 days) and are an additional $100. Unfortunately due to the following statue, you will not be able to purchase items made of python at trunk shows in your area. Your purchases can only be made on our site www.lineij-atelier.com which is based in New Orleans, and will mail it to 90210 and neighboring ZIP codes. It's legal to bring your own python across state lines, as long as you don't plan to sell it.

(a) It is unlawful to import into this state for commercial purposes, to possess with intent to sell, or to sell within the state, the dead body, or any part or product thereof, of any alligator, crocodile, polar bear, leopard, ocelot, tiger, cheetah, jaguar, sable antelope, wolf (Canis lupus), zebra, whale, cobra, python, sea turtle, colobus monkey, kangaroo, vicuna, sea otter, free-roaming feral horse, dolphin or porpoise (Delphinidae), Spanish lynx, or elephant. 24. Order Acceptance
Acceptance of your order occurs when you receive a shipping confirmation email, outlined with a shipping provider and tracking number. The email you receive immediately after placing your order, acknowledging the details of your order, does not confirm the acceptance of your order. Once we ship the goods to you and you have been charged, the sale contract between you, LINĒIJ™, and www.lineij-atelier.com will be complete. At any time before shipping your order, we reserve the right to not accept your order for reasons we deem appropriate, such as unsuccessfully authorizing a payment, verifying shipping/billing addresses, or other circumstances.
Bespoke Order Policy
Bespoke goods are any goods specifically personalized and/or tailored to your specifications. Orders for bespoke goods cannot be cancelled or changed [once work has started on them]. Bespoke goods delivered as described and are in good condition may not be refunded. We reserve the right to charge for re-posting of bespoke goods returned in error. There are no cash or other monetary refunds for bespoke items. Only website credit will be issued once.
LINĒIJ™ and www.lineij-atelier.com are not responsible for customer generated mistakes, errors or defects including spelling, color selection, finishes, hardware, typographical or grammar errors; order quantity, or other ordering errors. To prevent these errors from happening, please review your order carefully before submitting.
Faulty goods will be rectified free of charge. Any problems with your bespoke order must be reported to us within 7 days of receipt of good(s). Please e-mail firstname.lastname@example.org, who will contact you in regards to the fault and how to return the goods. Each item purchased can only be exchanged once.
Payment must be made in full upon placing the order. Order fulfillment time will vary based on the type of products ordered, type of customization, and the number of items ordered. Bespoke items require 4 – 10 weeks before shipping.
Any cancellation or change to the order is to be received within 5 days of the order being placed. Failure to comply with this will result in a 50% charge or the full value. From 6-10 days after order 75% of the full order. After 10 days 100% of full order. Before commencing a bespoke order our concierge will contact you to ensure your order is correct, and wait for you to respond before starting your order.
*Bespoke items are not eligible for site credit, are non-refundable and non-exchangeable.*
We will repair current and previous season accessories purchased from LINĒIJ™ and www.lineij-atelier.com. Current collection handbags will be repaired free of charge if the repair is deemed the fault of LINĒIJ™. All other repairs will be chargeable. Charges will be accessed once LINĒIJ™ receives the item(s). No repairs will be done until email consent is verified and payment is received.
All handbags that are returned to LINĒIJ™ usually take approximately 6-8 weeks to repair, but may take longer, depending on the nature of the repair. You are responsible for shipping costs associated with any and all repairs that are not the fault of LINĒIJ™.
LINĒIJ™ is unable to repair damage caused by everyday wear and tear.
We accept Visa, MasterCard, and American Express. Your order will be charged once we have shipped your goods. If your order contains multiple items, we will only charge you for the items we ship. Items that may have gone out of stock but were on your order will be charged when they are dispatched. By entering credit card information onto www.lineij-atelier.com, you are confirming that the information you provide is valid and is authorized by the holder of the card (you) to be used. If the issuer of your payment card refuses to authorize your transaction, LINĒIJ™ is not liable for any delays in shipping or non-delivery.
We take reasonable care to make www.lineij-atelier.com secure. All credit/debit card transactions on this site are processed using PayPal and Stripe - a secure online payment gateway that encrypts your card details in a secure host environment. We take considerable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from www.lineij-atelier.com.
25. Product Pricing
Prices shown on www.lineij-atelier.com are automatically defaulted based on your location. LINĒIJ™ deals in USD, CND, EUR, YEN, and GBP. All prices shown on the website are excluded of taxes, duties and shipping. Currency exchange rates on product prices are determined daily and these prices are subject to change depending on the fluctuation of currency exchange rates.
If the country you are purchasing from is served as DDP, you will incur the relevant import duty and tax, which is included in the final purchase price. If purchasing from a country served as DDU, you will be charged for the items you are purchasing and their shipping costs only. The subsequent duties and tax will be invoiced to you directly by UPS or an import broker appointed to you. You may want to contact a local customs authority office to determine a landed cost price prior to completing your order.
26. Sale Price Adjustment Policy
LINĒIJ™ will offer price adjustments on first markdowns only. If an item has been reduced from its full price within seven days of your purchase date, we will credit you the difference in the original form of payment. A price adjustment request must be made to our concierge within the appropriate time frame by clicking here.
Please be aware that the exact style and size of an item must be available for purchase at the time your request is made before any adjustment in the sale price can be approved. We are unable to offer price adjustment on items originally purchased in a sale or on any special promotion items that are temporarily reduced in price. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked-down.
27. GIFT CARDS
No additional fees on the sale of LINĒIJ™ gift cards, and they do not expire. Gift cards are redeemable towards all merchandise on the LINĒIJ™ site. LINĒIJ™ gift cards are non-transferrable and cannot be refunded or redeemed for cash. For gift card payments where the order total is less than the value of the gift card, the remaining balance will be credited to your account to use against future orders. The balance of your gift card can be checked at any time via your ‘My Account’ page. If your order total exceeds the value of the gift card, you must pay the remaining balance by credit card. For returns that were purchased using a gift card, the balance will be credited to your account as a store credit to use against future purchases. Your store credit can be checked at any time via your ‘My Account’ page. All applicable sales tax, duties, and shipping are applied to purchases made using a gift card. LINĒIJ™ is not responsible for lost, stolen, destroyed, or unauthorized use of gift cards; we reserve the right to cancel a gift card should we deem it necessary.
Virtual Gift Cards
Virtual LINĒIJ™ gift cards will be e-mailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.
LINĒIJ™ is not liable for the delivery of a Virtual Gift Card to an incorrect or non-existent email address; this is the sole responsibility of the purchaser.

28. Insurance & Delivery
Your package will be insured by LINĒIJ™ from the moment it ships from our facilities until the time it is delivered to the specified delivery address. Upon receiving your package, responsibility for your goods is passed onto you. For orders that are not being delivered to you, such as a gift package, delivery and fulfillment by LINĒIJ™, and responsibility will then transfer the person receiving the gift.
29. Exchanges & Returns
If you cancel your order before the shipping of any goods your money will be refunded and the goods will not be delivered. All products offered on www.lineij-atelier.com and LINĒIJ™ are hand crafted, as a result www.lineij-atelier.com and LINĒIJ™, does not offer cash refunds on any of its products – item(s) can be returned for website credit, or each item purchased can be exchanged once.
To ensure that you are completely satisfied with your purchase, you can ONLY exchange merchandise to LINĒIJ™ and www.lineij-atelier.com within two weeks (14 days) of the original purchase date. In cases where a CITES Certificate is needed, the exchange period will be two weeks (14 days) from the date the recipient and or customer receives the item(s).
All sale, bespoke, and limited edition items are final sale, and cannot be exchanged for any reason. All merchandise must be accompanied by the original sales receipt and must be in perfect, saleable condition with the original tag attached. Refunds will be applied to the original payment method.
LINĒIJ™ will not issue a refund for merchandise that does not meet the above conditions. Merchandise that has been worn, used, altered or damaged will be denied. If your returned merchandise is not accepted, for reasons we deem appropriate, you will be notified via email to the email address you provided during checkout. Within two weeks (14 days) of being notified that you are not entitled to a refund, you will have the ability to request that your merchandise be shipped back to you in the condition that it was received by our customer service, at your own cost. You have two weeks (14 days) to reply with a written request for the return of your merchandise, in which you must agree to pay for return shipping and specify the method of payment for this service. If this is not done within two weeks (14 days), you are authorizing LINĒIJ™ to dispose of such merchandise.
All shipping charges incurred by purchasing an item online are non-refundable. LINĒIJ™ does not accept returns of merchandise that were not purchased online. All sales at pop-up stores, trunk shows, as well as any and all special events are final – there are no returns and or exchanges offered.
30. Defective Goods
Goods are ONLY considered defective if they are received damaged and www.lineij-atelier.com is notified within 7 days of the items being received by the end user. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

Please keep in mind is that leather and other exotic materials are natural products. Each hide is just as unique as your fingerprints. The color, texture, and markings vary from hide to hide and even within a single hide. It is not unusual to see color differences, grain changes, and even scars can be seen on some products. Since all of our leathers and exotic skins are byproducts of the food industry, they are in the open with nature. As a result cattle horns, insect bites, Scratches, nicks, scares, brands, other variances due to age and sun may leave visible scars. LINĒIJ™ and will not exchange items due to the naturally occurring variances.

Verification of Requirements for Suppliers
LINĒIJ™ has implemented LINĒIJ™ Code of Good Conduct (“Code”) for its suppliers. The Code sets forth and establishes non-negotiable minimum standards for LINĒIJ™’s suppliers in the areas of health and safety, labor standards, business integrity and the environment. In addition, LINĒIJ™ may conduct third-party supplier audits, described below, in order to verify that its suppliers are complying with these minimum standards.

LINĒIJ™ audits suppliers that, based upon an analysis of the volume of the supplier’s business and the risk of abuses in the country in which the supplier is located, pose a high risk of working condition violations. These audits are conducted to insure that suppliers are compliant with Social Accountability International’s SA8000 standards, an international standardized code of conduct for improving working conditions around the world, and are compliant with the Code.

In the event LINĒIJ™ becomes aware of any actions or conditions not in compliance with its Code, LINĒIJ™ reserves the right to demand corrective measures.
